Accotink Stormwater TMDL Lawsuit

Fairfax County and VDOT filed a lawsuit on July 12, 2012 against the EPA to stop the implementation of the Accotink Total Maximum Daily Load (TMDL) requirements. The fact that Fairfax County's Board of Supervisors, a leader in Environmental Protection, put aside politics and joined forces with VDOT illustrates the unbearable magnitude of the requirements of the Accotink TMDL (Field Notes Vol 19 No. 3), which would affect both governments and all land owners in the watershed.

The unanswered question will be whether or not other affected government entities (Town of Vienna, City of Fairfax and Department of the Army), land owners (individuals, Home Owners Associations, homebuilders and commercial and industrial owner/developers), and environmental groups (litigation by the American Canoe Association and the American Littoral Society forced the schedule for the development of the Accotink TMDL, similarly a lawsuit by the Chesapeake Bay Foundation dictated the Chesapeake Bay TMDL implementation schedule) will join in on one side or the other of this lawsuit.
